It does not only have the power to seize one’s property and then sell it but it also can seize one’s property even before getting a judgment against the owner in court. However one must understand that IRS also has boundaries before they could seize and sell one’s property. There are five events that have to take place before they can do so and these are:
- The assessment of tax by the IRS against you. In this case, the value of the tax is already determined as well as recorded by the IRS as a total amount that one do not contradict or dispute.
- There should be an issuance of notice as well as demand by the IRS for you to pay your tax.
- One should refuse paying the assessment given within 10 days after the given notice and demand.
- “Notice of Intent to Levy” should be send by the IRS
- One fails to pay the liability in tax within the period of 30 days after being sent the “Final Notice of Intent to Levy.”
